102年律師考試心得--質變的確定

這兩天考完律師，可以確定改成二試後，律師考試已經整個質變。

出題老師似乎已經把所有通過一試的人都認定具有律師水準，已經不考一些連學界都無解的法學難題，考的題目都極為簡單極為單純，讓你不得不懷疑真有這麼單純？單純得像佛斯特的小詩，但每題都必須有基本的概念，這種題目如果照補習班的解法去寫，保證必死無疑，所以出題老師似乎也有意想刻意壓抑那些台北車頭法學院訓練過的考生。

我考完這兩天，行雲流水般的審題解題下筆結論，看著自己極其完美又簡潔明瞭的答案，再看看手錶，天呀只剩不到一分鐘，再看看其他考生發了狂的振筆疾書，我就知道，今年考試，答題簡潔是關鍵，要是一題給他來個甲說乙說丙說肯定說否定說折衷說德國通說實務見解，保證一題就爆。

欣見律師考試有這樣的改變，出題老師終於知道律師考試找的是適合當律師的人而不是法學者，要挑的是知道案件重點在哪的人而不是判例或釋字的背誦者，我曾經站在重慶南路書店街的那片國考書籍牆前，忘著那一本本的重點整理，釋字精選，學說判例解題三合一等等參考書發呆，心想就算是最用功的學生也難以消化吧。

考完試離開試場時，看見滿滿的人潮塞爆了木柵路，真難以相信這麼一大群黑壓壓人中竟然有三分之一在兩個月之後都會取得律師資格，我心中不禁響起那首著名的美國民謠a million lawyers中的歌詞：不久的將來，這個國家將有一百萬名律師，喔，天知道會發生什麼事？喔，天知道會發生什麼事？

願神州大地，莘莘學子，都能夠悠遊學海，真正享受學習的樂趣。

回覆	學說明明有考在10/27/2013 10:59:18 PM的回覆：扣掉必考學說的憲法，律師商事法第一題第三小題直接問「學說上有無爭議之處」耶！
